Where We Help

Estate planning is not only for the wealthy. It is for anyone who wants to choose the people responsible for their affairs, give clear direction about the future, and reduce avoidable uncertainty for the people they care about. We explain the choices that matter and prepare Ontario estate-planning documents that reflect your circumstances.

Vosooghi Law serves families in Richmond Hill, North York, Toronto, York Region, and throughout the GTA. We provide bilingual service in English and Persian, with practical guidance for straightforward planning as well as more complex family, business, and estate-administration matters.

01

Powers of Attorney

A power of attorney lets you choose a trusted person to make certain decisions for you if you cannot make them yourself. In Ontario, a Continuing Power of Attorney for Property can authorize someone to manage financial and property matters. A Power of Attorney for Personal Care can authorize someone to make personal care decisions, including decisions relating to health care, housing, nutrition, safety, and other aspects of daily life.

These documents operate during your lifetime and serve a different purpose from a Will. They should be prepared with care because the person you appoint may have significant responsibility. We help you consider who to appoint, whether to name an alternate, and what instructions or limits may be appropriate for your circumstances.

For clients in Richmond Hill, North York, and the GTA, we prepare powers of attorney that are clear, tailored, and properly executed in accordance with Ontario requirements.

02

Last Wills & Testament

Your Will can name the estate trustee you wish to administer your estate, set out how you want your assets distributed, and record your wishes about the care of minor children. It provides an opportunity to make thoughtful choices rather than relying on the rules that apply when a person dies without a Will.

A well-prepared Will should account for your family relationships, assets, debts, beneficiary choices, and the people you trust to carry out your instructions. It may be especially important to seek tailored advice if you have a blended family, young children, a business interest, property, beneficiaries with particular needs, or gifts that require careful wording.

Our wills lawyers prepare clear, properly executed Ontario Wills and explain the key decisions before you sign. We also help clients review an existing Will after a marriage, separation, birth, death, move, major purchase, business change, or other significant life event.

03

Probate

Probate is the common name for an application to the Ontario Superior Court of Justice for a Certificate of Appointment of Estate Trustee. Depending on the circumstances, a financial institution, land registry office, or other organization may require a certificate before it will deal with an estate trustee. The process can involve a Certificate of Appointment of Estate Trustee With a Will or Without a Will, along with supporting documents and other estate-administration requirements.

Being an executor can be a demanding responsibility. Estate administration may include locating assets, communicating with beneficiaries, paying debts, arranging tax filings, managing estate property, and making appropriate distributions. Each estate is different, and the scope of the work depends on the assets, family circumstances, and whether there is a Will.

We guide executors through probate applications and estate-administration steps with a focus on clear information, accurate filing, and practical next steps. If you are looking for a probate lawyer in Richmond Hill, North York, or the GTA, we can help you understand the process and your role as estate trustee.

The Planning Process

A thoughtful plan begins with the right questions.

Estate planning begins with an overview of the people and property that matter to you. We discuss your family relationships, the people you would trust to act, your assets and business interests, and the instructions you want to leave. We then explain the documents that may be appropriate, including a Will and powers of attorney for property and personal care.

At the signing meeting, we review the documents with you, answer questions, and ensure the execution process is handled correctly. You leave with a clearer understanding of your plan and the importance of keeping your original documents in a safe location that your executor or trusted person can identify when needed.

Why It Matters

Six reasons to have a valid Will.

01

Control the Distribution

You can set out how you want your estate distributed, rather than relying on Ontario’s intestacy rules.

02

Choose Your Children’s Guardian

You can record your wishes about who should care for your minor children, which is an important consideration if a court appointment is needed.

03

Choose Your Executor

You can name the person you want to act as estate trustee and carry out your instructions.

04

Reduce Final Costs

Clear instructions and an appropriate estate plan can help reduce avoidable administrative work and professional costs.

05

Reduce Delays

A clear Will can make it easier for an estate trustee to understand and carry out your instructions.

06

Prevent Escheat

You can choose beneficiaries and make specific gifts that reflect your wishes and relationships.

Common Questions

Wills, powers of attorney, and probate FAQ.

What is the difference between a Will and a power of attorney?

A Will takes effect after death and gives directions about your estate. Powers of attorney operate during your lifetime and allow a trusted person to make specified property or personal care decisions if you cannot make them yourself.

When should I update my Will?

Review your Will after significant life changes, such as a marriage, separation, birth, death, move, major asset purchase, change in your business, or a change in your intended executor or beneficiaries. A review helps confirm that your documents continue to reflect your wishes.

Is probate always required in Ontario?

Not every estate requires a probate application. Whether it is needed depends on the assets, how they are held, the financial institutions involved, and the estate’s circumstances. We can review the situation and advise on the appropriate next steps.

Do you serve clients outside Richmond Hill?

Yes. Vosooghi Law serves wills, powers of attorney, and probate clients in Richmond Hill, North York, Toronto, York Region, and throughout the Greater Toronto Area. We can discuss whether virtual communication is appropriate for your matter.
